Your first hearing will be an arraignment, and that’s when you’ll enter your plea and file all the substantive and discovery motions necessary to provide your defense. This arraignment will be followed by pretrial hearings, during which you may be able to negotiate a plea. If your case goes to trial, it can be handled in the Municipal Court if that’s where you were arraigned, or at State Court. The benefit of the smaller Municipal Courts is that they’re typically more accessible for negotiations and rescheduling court appearances, and many of the Municipal Courts in Cobb County even have programs that allow first time offenders to take responsibility for their actions while maintaining a clean criminal record. However, if you decide to have a jury trial, your case will be bound over to State Court, because Municipal Courts don’t hold jury trials, but rather bench trials, where your fate is completely in the hands of the judge.
