After a witness observed him driving erratically with his 7-year-old son in the back seat, an officer caught up with him and levied DUI charges, for which Cross was arrested. He had to call his wife to come pick up their son, and he fought his Alpharetta DUI for almost a year before the charges were dismissed. Ultimately, the judge decided that the arresting officer didn’t have probable cause, having not personally witnessed him driving erratically. The officer also detained Cross first, and asked questions afterward. The good news is that Cross was acquitted of the charges, but the fact that it took 11 months for this city councilman to see the charges drop is disheartening. Moreover, how was the little boy in the car affected when this officer, who had no specialized DUI training, took his father to jail?

We have a few points to make here:

The first, of course, is that you should never drink and drive, especially with children in the car. Even if you’ve only had a little bit to drink, and for some reason you’re stopped by police—whether it’s for a bad taillight, for speeding, or, as in Cross’s case, a “jerk” in your lane changing—an officer can take you in on DUI charges. Seeing your child frightened by a parent’s arrest or worse, having to sit with strangers waiting for a familiar face to come collect him, is not worth that glass of wine with dinner!
