  • Super Speeder

    Am I a Super Speeder?

    Any person convicted of driving at a speed of 85 miles per hour or more on any road or highway or 75 miles per hour or more on any two-lane road or highway, as defined in Code Section 40-6-187. Such a driver, upon conviction, shall be classified as a "super speeder."

    Section 40-6-187 Requirement for recording speed driven, maximum legal speed and road conditions on charge of speed violation

    (a) In every charge of violation of any speed regulation in this chapter, the summons, uniform traffic citation, official charging instrument, or notice to appear shall specify the speed at which the defendant is alleged to have driven, the maximum speed applicable within the district or at the location, and whether the violation occurred on a two-lane road or highway. For purposes of this Code section, the term "two-lane road or highway" means a road or highway with two lanes for through-traffic movement exclusive of any portion of the road or highway adjoining the traveled way for parking, speed change, turning, weaving, truck climbing, or other purposes supplementary to through-traffic movement.
    (b) For the purpose of imposing points pursuant to Code Section 40-5-57, every sentence for a violation of any speed regulation in this chapter shall state the specific amount by which the person convicted exceeded the speed limit.

    What effect does a super speeder have?

    In addition to any other fines or penalties imposed by any local jurisdiction, the Department of Driver Services will impose and collect a fee of $200.00.

  • Point System

    How many points am I allowed to get against my license before the Department of Driver Services suspends my license?

    You are allowed to get 15 points within 24 months under the point system, including violations committed out of state, before the Department of Driver Services suspends your license.

    How many points go against my license for speeding?

    Points for speeding vary depending on your speed.

        Under 14 mph     0 points
    15 mph but less than 19 mph 2 points
    19 mph but less than 24 mph 3 points
    24 mph but less than 34 mph 4 points
    34 mph or more 6 points

    How many points go against my license for Reckless Driving?

    6 points

    How many points go against my license for Unlawful Passing School Bus?

    6 points

    How many points go against my license for failure to obey a traffic-control device or traffic officer?

  • License Suspension

    What traffic violations will suspend my driver’s license?

    The Department of Driver’s Services will suspend your license for a conviction of any of the following offenses:

    • Homicide by vehicle.
    • A conviction for driving under the influence of alcohol or drugs.
    • Any felony in the commission of which a motor vehicle is used.
    • Using a motor vehicle in fleeing or attempting to elude an officer.
    • Fraudulent or fictitious use of, or application for a license.
    • Hit and run or leaving the scene of an accident.
    • Racing.

    If you refuse to take a chemical test for intoxication, then your license will be suspended for 12 months.

    Operating a motor vehicle with a revoked, canceled, or suspended registration in violation of Code Section 40-6-15.

    Conviction for driving without insurance is a 60/90-day suspension.

    If convicted for driving while license is suspended, revoked or canceled, your driver's license will be further suspended for six months.

    If you fail to appear in court or respond to a citation, your license may be suspended indefinitely.

    Your driver's license will be suspended if you are convicted of possession, distribution, manufacture, cultivation, sale or transfer of a controlled substance or marijuana.

    The Department is authorized to suspend your license if its records or other evidence shows that you have accumulated 15 points within 24 months under the point system, including violations committed out of state.

  • FTA (Failure To Appear)

    What is an FTA?

    An FTA is “Failure To Appear” for your court date

    What effect does a FTA have?

    First the judge will issue a warrant for your arrest.

    Second the Department of Driver’s Services will suspend your license until the “FTA” is removed by the original judge in your case.

  • Possession of Marijuana Less than an Ounce

    What is possession of marijuana less than an ounce?

    Possession of marijuana less than one ounce is a misdemeanor offense in Georgia and can be punished by up to one year in jail and a fine of up to $1,000.

    Can I lose my Driver’s License for having marijuana less than an ounce?

    Yes, if convicted of having marijuana less than an ounce the Department of Driver’s Services will suspend your drivers license for a period of 6 months for your first offense, 1 year for your second offense, and 2 years for your third and subsequent offense.
