Automobile Accidents

If you are involved in an accident caused by an “at-fault” negligent driver, here are some important things to do to preserve your claim:

  1. Call 911 and report the accident to the police.  If anyone is injured, request that EMS also be called.
  2. Take photos of the damage to the cars involved in the accident.  Don’t forget to take photos of the car’s interior (airbag deployment, cracked win shield, damaged dashboard, etc.), as this can be evidence of the force of the collision.
  3. Whether or not the accident is your fault, tell the police officer on the scene your complete story. Be sure the officer knows what injuries you sustained—even if at the time you only feel “stunned and shaken-up”—so he can include that in the his report.
  4. If you are injured, request an ambulance.  Let the EMTs know the full extent of your pain and injury.  Police reports and EMT reports can be used by the Defendant’s insurance company to show that you did not report any pain or injuries at the scene, and to deny your claim.
  5. If you have a PPO or an HMO, call the 800 number as soon as possible to report your injuries, and to get a medical provider referral.

  8.
