Larceny

Larceny is the wrongful taking of a person’s property with the intent to make it your own.  The crime of larceny can be defined in several ways, such as:

  • Larceny by Fraud— illegal credit card use or telemarketing scams;
  • Larceny by Deception—scams and price altering; or
  • Larceny by Tricks—swindling or Ponzi schemes.

There are additional criteria which affect how a prosecutor or judge will perceive the charges; however, larceny can easily earn a prison sentence of many years. O.C.G.A. §16-9-50 through O.C.G.A. §16-9-62.

Under Georgia law, punishments often increase with the amount of money involved in a crime.  In theft crimes, the more money that is involved increases penalties and risks, including extended jail time, felony convictions and monetary fines.
